These Terms & Conditions govern your access to and use of the Shivba Food Fast mobile application and related services. By using our services, you agree to comply with these terms.

1. Acceptance of Terms

These Terms & Conditions constitute a legally binding agreement between you and Shivba Food Fast regarding your use of our mobile application and related services.

By accessing, registering, or using Shivba Food Fast, you agree to be bound by these Terms & Conditions and all applicable laws and regulations.

If you do not agree with any part of these Terms & Conditions, you should discontinue use of the application immediately.

2. Eligibility

Shivba Food Fast is intended for individuals who are at least 18 years of age.

By using the application, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into this agreement.

We reserve the right to restrict access or terminate accounts found to be in violation of this requirement.

3. User Accounts

Users are required to register and verify their mobile number through OTP authentication to access Shivba Food Fast services.

Users are responsible for maintaining the accuracy of their account information, including name, gender, and delivery addresses.

Users must not share OTPs or allow unauthorized access to their accounts.

Shivba Food Fast shall not be responsible for any loss or damage resulting from unauthorized use of a user's account.

4. Orders & Availability

Shivba Food Fast allows users to browse restaurant menus, place food orders, and request delivery services through the application.

All orders are subject to restaurant acceptance, item availability, service availability, and delivery coverage.

Shivba Food Fast reserves the right to refuse, cancel, or limit any order due to operational, technical, pricing, or availability issues.

Restaurant menus, food items, prices, offers, and availability may change without prior notice.

We do not guarantee that every listed item will always be available for purchase.

5. Pricing & Charges

The prices displayed within the application are provided for customer convenience and may be updated from time to time.

Delivery charges may vary depending on location, restaurant, distance, promotions, or business requirements.

Users are responsible for reviewing the final order amount before confirming an order.

Shivba Food Fast reserves the right to modify food prices, delivery fees, service charges, offers, and promotional discounts at any time without prior notice.

Any pricing errors identified after an order is placed may result in order modification or cancellation.

6. Delivery Services

Shivba Food Fast currently provides food delivery services within selected serviceable areas, including Narayangaon, Maharashtra and nearby delivery locations.

Delivery times displayed within the application are estimates only and may vary due to weather conditions, traffic, restaurant preparation time, operational constraints, or unforeseen circumstances.

Customers are responsible for providing accurate delivery addresses and contact information to ensure successful delivery.

If a delivery cannot be completed due to incorrect customer information, unavailability of the customer, or other customer-related issues, Shivba Food Fast reserves the right to cancel the delivery request.

While we strive to provide timely deliveries, we do not guarantee delivery within a specific timeframe.

7. Cancellation Policy

Customers may request cancellation of an order before the restaurant has accepted, prepared, or dispatched the order.

Once a restaurant has started preparing the food or the delivery process has been initiated, cancellation requests may not be accepted.

Shivba Food Fast reserves the right to determine whether an order is eligible for cancellation based on operational status, restaurant confirmation, and delivery progress.

Repeated misuse of cancellation facilities may result in restrictions on future orders or access to certain services.

8. Refund Policy

Shivba Food Fast currently operates primarily on a Cash on Delivery (COD) model.

Since payments are generally collected upon successful delivery, refund situations are currently limited.

In the event that online payment methods are introduced in the future, refund requests will be reviewed based on the specific circumstances of the order and applicable payment policies.

Approved refunds, where applicable, may require reasonable processing time and may be subject to verification procedures.

Shivba Food Fast reserves the right to refuse refund requests that do not comply with these Terms & Conditions or applicable business policies.

9. Payment Terms

Shivba Food Fast currently supports Cash on Delivery (COD) as the primary payment method.

Customers are responsible for paying the full order amount, including applicable delivery charges and taxes, at the time of delivery.

We reserve the right to introduce additional payment methods, including online payment gateways, digital wallets, UPI, credit cards, debit cards, or other payment solutions in future versions of the application.

Any future online payment transactions will be subject to additional payment provider terms, security requirements, and applicable regulations.

Shivba Food Fast shall not be liable for payment failures, banking interruptions, or technical issues arising from third-party payment service providers.

10. Restaurant Information & Menu Accuracy

Shivba Food Fast displays restaurant information, menus, food items, prices, availability, and promotional offers for customer convenience.

While we make reasonable efforts to ensure that information displayed within the application is accurate and up to date, we do not guarantee the completeness, accuracy, or reliability of such information at all times.

Restaurant menus, prices, ingredients, availability, preparation times, and offers may change without prior notice.

Shivba Food Fast shall not be held responsible for menu inaccuracies, item unavailability, pricing discrepancies, or restaurant-related issues beyond our reasonable control.

Customers are encouraged to verify order details before confirming their purchase.

11. User Responsibilities

Users are responsible for providing accurate and complete information while using Shivba Food Fast services.

Shivba Food Fast shall not be responsible for delays, interruptions, restaurant-related issues, traffic conditions, weather events, technical failures, or circumstances beyond our reasonable control.

Our maximum liability, if any, shall be limited to the amount paid by the customer for the specific order giving rise to the claim.

Nothing in these Terms & Conditions shall exclude liability where such exclusion is prohibited by applicable law.

13. Intellectual Property Rights

All content, trademarks, logos, graphics, text, software, application designs, and other materials available through Shivba Food Fast are the property of Shivba Food Fast or its licensors and are protected by applicable intellectual property laws.

Users may not copy, reproduce, modify, distribute, republish, transmit, or exploit any content from the application without prior written permission.

Unauthorized use of any intellectual property may result in legal action and termination of access to the services.

14. Service Availability & Modifications

Shivba Food Fast continuously works to improve its services. We reserve the right to modify, suspend, discontinue, or update any part of the application at any time without prior notice.

Service availability may vary depending on location, operational conditions, restaurant availability, technical maintenance, or unforeseen circumstances.

We do not guarantee uninterrupted access to the application and may perform maintenance or upgrades when necessary.

15. Future Features & Updates

Shivba Food Fast may introduce new features, tools, services, payment methods, delivery options, loyalty programs, customer reviews, ratings, and location-based functionality in future versions of the application.

Such features may be subject to additional terms, conditions, policies, or requirements as applicable.

Continued use of the application after the introduction of new features shall constitute acceptance of any applicable updates.

16. Changes to Terms & Conditions

Shivba Food Fast reserves the right to update, revise, modify, or replace these Terms & Conditions at any time.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising from or relating to the use of Shivba Food Fast services shall be subject to the exclusive jurisdiction of the competent courts located in Maharashtra, India.

Users agree to submit to the jurisdiction of such courts for the resolution of any legal disputes.
